The Shape of Judgement

The Seminar explored differences in dissent practices across different international tribunals and address the following questions:

  • Why do some courts (ICJ, ITLOS) virtually always have dissents, and others rarely or never (ECJ, WTO)?
  • What difference does it make for law development, the authority of the court and the independence of the judges?
